Roommate Agreement
1. Parties
This Roommate Agreement is made on (date of renewal) between:

Tenants and Lessee can collectively be referred to herein as "tenants".
2. Premises
Tenants agrees to lease an area consisting of the entire premise, located at: xxxxx xx Drive, xx xx Florida. Tenants have unmitigated physical access to any area within the premise, barring personal rooms of other tenants. Tenants may adorn and fashion any accessible area within the premise with the sole limitation that such adornments be wholly reversible at the end of Tenant's term.
3. Term
The term of this roommate agreement shall commence on July 21st, 2024, and end on July 21st, 2025, unless terminated earlier in accordance with this Agreement.
Tenants shall have no penalty for terminating this agreement under the condition that a period of four weeks, or twenty-eight (28) days, is granted to the Lessee. In the event that an agreement is terminated early, remaining Tenants have the freedom to introduce a new Tenant, otherwise they will be responsible for a 50/50 split of house-maintenance fees and Rent.
In the event that the recommended notice is not given, it is up to the discretion of the Lessee to apply a $500 fee due at the time of the next rent payment, used to cover upcoming costs for the next month of rent for the remaining tenants. The Tenant will no longer be responsible for turning in rent to the Lessee. It is the responsibility of the Tenant to return their personal area and adornments to a condition similar to the condition they first inhabited it in.
4. Rent
Tenants agree to pay a monthly rent of $800 to the Lessee, due on the 20th day of each month [known as the Rent Due Date]. Rent is derived from a base rent charge of $666.66 covering actual rent, with an additional $133.34 covering recurring house-maintenance fees (HMFs), such as Internet utility (approximately $90 monthly), and electricity utility (approximately $150 monthly).
Rent shall be paid to North via any of the following methods, in order of preference.
- eCheck or equivalent digital payment method, limited to Cash App, PayPal, Zelle, or Pay-a-Person via Suncoast Credit Union
- paper US currency
North will then submit a single payment to the homeowner on the 21st of each month, the canonical Rent Due Date. Please ensure that the received amount equals $800 when using an eCheck or equivalent method, and also ensure that the payment will arrive on or before the Rent Due Date.
Each month, the remainder of the $133.34 from each of the Tenants will accrue in a federated House Financial Account (HFA), of which will be responsible for providing basic materials and maintenance for the premise. For example, bathroom materials and clothes-washing materials are deducted from the HFA rather than an personal bank account of a tenant.
5. House Financial Account, continued
Tenants will cumulatively contribute to a HFA which is included in their monthly rent payment. The remainder of the Rent payment from each tenant that withstands each utility will automatically become deposited to this HFA. All parties will have access to the funds within the HFA at any time, for the sole purpose of maintaining and adorning the premise. Tenants may contribute to the welfare of the premise from personal financial accounts on their own volition; no retribution is expected from other parties in such scenario. In the event that HFA funds are insufficient to maintain the premise, a rotation will be established between all available tenants to cover HMFs.
This HFA will be established within Cash App.
6. Guests
Tenants are allowed to have any amount of guests over, provided that any kind of notice of at least 15 minutes is given to Lessee. No explicit confirmation from Lessee is required to allow guests over, unless Lessee explicitly denies a guest visitation within the 15 minute notice. If the guest is a significant other, no notice is required.
7. Pets and Allergies
Due to North's allergies to numerous animals, the following provisions apply:
- Shedding animals: The presence of shedding animals in the shared living space must be promptly cleaned of all residual hairs and dander if and once Lessee enters the shared living space. Once Lessee leaves the area, these pets may have unfettered access to the entire premise, barring personal rooms of other Tenants. This is not to say that the animals may not co-exist in a room with the Lessee; only that any excess residue and fur is cleaned once Lessee enters a shared living space.
- Cleanliness: The Tenants agree to maintain a clean and allergen-free environment, particularly in common areas.
- Notification: The Lessee must be informed in advance if there are any plans to introduce additional pets to the property temporarily.
8. Temperature Maintenance
Your original lessee, North, has an severe sensitivity to cooler temperatures. In particular, exposure to the sustained forced-air from the central AC unit for any duration of time leads to unwanted and distressing physiological issues, and this functionality is required to be limited while this lessee is located in the premise.
North has a room-scale heater that will be used to counteract the forced-air AC, so that other tenants can continue enjoy temperatures comfortable to them within their own rooms. However, in the event that this heater is unavailable, Tenants must be made aware that usage of the forced-air function of the AC unit needs to be limited while this tenant is within the house.
While this lessee is located within the main living area of the house, Tenants also agree to confer with the original lessee before adjusting the central AC unit's settings.
Note that, if the aforementioned lessee is not within the main area of the house at any given time, the Tenants assume full control over the AC's settings.
Tenants are encouraged to explore and incorporate personal air-conditioning solutions within their room.
9. Maintenance and Repairs
The Tenants shall promptly report any maintenance issues to the Lessee.
The Lessee shall be responsible for arranging for necessary repairs. The tenant responsible for any damage will be primarily responsible for the related fees for repair, otherwise such fees will be funded with what is available within the HFA, then each tenant.
10. Termination
Withstanding the provisions in 3. Term, any party may terminate this Agreement with 28 days’ written notice. In the event of a serious breach of this Agreement, the Lessee may terminate the Agreement immediately.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Florida and Lee County.
12. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind. In the event that issues or clarifications are decided verbally after the signature of this agreement, an amendment to this lease agreement will need to be signed by all parties. In addition, all provisions of the original Lease supersede any conflicting provisions introduced within this document.
